Terms and Conditions – Atlus Connect Pty Ltd
Terms and conditions on which Atlus Connect Pty Ltd ABN 59 664 134 874 (“Atlus Connect”) provides services to consumers.
No Emergency Care; Certain Services and Items Excluded.
If you have an emergency, you must dial 000. Atlus does not treat emergencies. Atlus Connect is a health service provider that provides a range of professional services; but it is not intended as a primary care physician/practitioner and, while its practitioners can order prescriptions, ancillary services such as diagnostic tests/x-rays, and laboratory services, it does not provide medications or those services itself. Engagement of Atlus is not intended to take the place of your primary care physician.
Atlus Connect provides services on the following terms and conditions.
The meaning of some words used in these terms and conditions:
CCA means Competition and Consumer Act 2010 (Cth).
Consulting Fees is the fee payable to Atlus Connect for provision of Services.
We, us or our is a reference to Atlus Connect Pty Ltd.
You or your is a reference to the person to whom we are providing our Services and who is required to pay for the Services we provide.
GST has the meaning given in A New Tax System (Goods and Services Tax) Act 1999 (Cth).
Parties is a reference to both us and you.
Services means the consultations with medical practitioners engaged by Atlus. The precise services we will be providing to you will be stated in the registration form and as we agree from time to time but will primarily involve telehealth consultations as booked with Atlus Connect on the terms of this Agreement.
You must pay the Consulting Fee when requested by us and as a condition of securing a consultation appointment by debit or credit card. If you fail to attend or cancel an appointment, the Consulting Fee is not refundable, unless the appointment is rescheduled by prior arrangement with Atlus Connect at least 48 hours prior to the time of the original appointment, in which case the Consulting Fee will be applied in payment for and to secure, the rescheduled appointment. The Consulting Fee is non-refundable in all other instances.
If, after payment of the Consulting Fee, Atlus Connect is unable to deliver the Services or provide any consultation appointment as booked for reasons other than your default, Atlus Connect will use all reasonable endeavours to reschedule the appointment. If satisfactory arrangements cannot be made, Atlus Connect may refund the Consulting Fee to you, and will have no further liability to you under these Terms and Condition. You must provide reasonable assistance to Atlus Connect in arranging your refund in accordance with Atlus Connect policies from time to time.
All amounts stated (whether orally or in writing) are exclusive of GST. If GST applies to any amount payable under these Conditions, You must pay, at the same time and in the same manner as the payment is made under these Conditions, any GST applicable to the supply evidenced by that payment.
No Insurance Accepted; Self-Payment Only.
Atlus Connect is a direct health care service; it is not health insurance. You will not be able to claim any part of your payments via Medicare or your health insurer.
If you are requesting Services on behalf of, and as a parent or legal guardian of a minor, such minor will be treated as a client hereunder and you will be responsible for their adherence to this Agreement. Atlus Connect shall not serve as and should not be considered a replacement for a primary care physician/paediatrician with respect to any minor. Any client under the age of 18 must have a separate primary care physician of record who is responsible for urgent care, vaccinations, and all routine paediatric health care services.
Atlus Connect may recommend you receive goods and services not offered by Atlus Connect (e.g., products, specialty services, diagnostic tests), but in no event will Atlus Connect be responsible for any amounts payable that result from services not offered by Atlus Connect. You are solely responsible for payment of fees payable to other providers for goods and services provided in the terms agreed between you and any such provider.
You must whenever reasonably requested by us, provide any health or medical information reasonably required by Atlus Connect to provide the Services including, without limitation, a health summary confirming your current diagnoses and medications. You consent to Atlus Connect contacting other health care providers to obtain verification and additional health information for the purpose of providing the Services.
If, after Atlus Connect provides any Service, you elect to use a product we recommend or prescribe, you agree to comply with any directions issued by any medical practitioner or pharmacist in relation to the product, including any directions that may accompany the product. Without limiting this, you must:
- Keep a log of your doses and changes in symptoms;
- Attend follow-up consultations as may be recommended by Atlus Connect or any prescribing practitioner;
- Not use any illicit or unlawful substances;
- Notify Atlus Connect of any changes to diagnoses or medications;
- Stop using any product if significant side effects are experienced, to seek medical attention immediately, and to contact Atlus Connect to arrange a consultation as soon as possible following any such event.
